Know which query is required.

For drivers subject to the applicable FMCSA drug and alcohol testing rules, employers must complete a full pre-employment query before safety-sensitive work and query at least annually. A limited query can satisfy the annual requirement when the applicable consent is obtained.

Keep consent with the workflow.

Limited queries require general consent obtained outside the Clearinghouse. Full queries require the driver’s specific electronic consent within the Clearinghouse. Record the previous query date and the next due date. If a limited query finds information, promptly follow the official full-query and safety-sensitive-work requirements.

Different records. Different tasks.

A Clearinghouse query checks a different record from an MVR. Neither is a drug test. Buying a plan does not itself complete a query or obtain a driver’s consent.
